Decades ago, the Supreme Court weakened the separation of powers in our constitution by allowing Congress to delegate authority so long as it articulated an “intelligible principle” for administrative agencies to follow. The phrase “intelligible principle” has turned out to be language more flexible than meaningful. A return to an original understanding of the the non-delegation doctrine would make the rampant expansion of federal power simply impractical.
